writes:I divorsed my husband 10 years ago. We had a court agreement in which he agreed to pay maintenance for both children. One is now grown up and quite rightly, he has stopped paying for him. For the past 10 months he has stopped paying for the second child and refuses to do so saying that that "He has all the evidence not to pay me a single penny". I feel that the only option is to take him to court, but I am fearful of his claim. I may not be the perfect mother, but I am loving, feed, cloth and provide support for my son. Can my ex husband stop paying maintenance without the court's approval? Reply to this Question |

reader, anonymous, writes (5 December 2007): Dear anonymous,aren't men just the pit's.In answer to your question,provided your child is still in full time education your ex does NOT have the right to stop any maintenance.If as you say the amount was ordered by the court,your ex has to apply to that same court to have the amount altered.As for him having "All the evidence" to stop paying,all I can say is,let him provide the court with it.If he's that confident he won't have a problem with this.I hope this has helped.Take care xx

reader, anonymous, writes (9 November 2007): No he needs to continue paying his obligation. Even if he has some evidence to a claim, what ever it is against you doesn't feel and cloth a child. His financial obligation still continues until an order from the court has been issued. I'd file contempt, and take him to court. Remember it's not what's in the parents best interest, maintenance is in the child's best interest.
